1. Eligibility & Accounts
- Account holders must be adults. You must be at least 18 years old (or the age of majority where you live) to create and manage an account. Accounts are created by parents, guardians, or authorized teachers.
- Children use the Service under supervision. Child profiles are set up and managed by an adult account holder, who is responsible for the child's use of the Service. See our Privacy Policy for how we handle children's information.
- Account responsibility. You agree to provide accurate information, keep your login credentials secure, and accept responsibility for activity under your account. Notify us promptly of any unauthorized use.
- Educators. If you create student accounts as a teacher or school, you represent that you have the authority and any required permissions to do so.
2. The Service
AceURMath provides adaptive math practice, an AI tutor, a Homework Scanner, games, assessments, rewards, and progress reporting for learners from Kindergarten through 12th grade, plus MAP and SAT prep. We may add, change, or remove features at any time to improve the Service.
3. Subscriptions, Billing & Free Trial
- Plans. Current plans and prices are shown on our pricing page. Subscriptions may be billed monthly or yearly.
- Free trial. New users may start a free trial as described at sign-up. If you do not cancel before the trial ends, your selected plan begins and billing starts.
- Auto-renewal. Paid subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your payment method is charged for renewal at the then-current price.
- Managing & cancelling. Subscriptions purchased through the Apple App Store or Google Play are managed in your device's account settings; subscriptions purchased on the web are managed through your account. You can cancel at any time, and access continues until the end of the current billing period.
- Refunds. Purchases made through the Apple App Store or Google Play are subject to those stores' refund policies. For purchases made directly through our website, contact [email protected].
- Price changes. We may change prices or plan features. We will provide reasonable notice of material changes, and changes apply to future billing periods.
4. Acceptable Use
You agree not to:
- use the Service for any unlawful, harmful, or fraudulent purpose;
- copy, modify, distribute, sell, reverse-engineer, or create derivative works from the Service except as permitted by law;
- access the Service through automated means (scraping, bots) without our permission;
- interfere with or disrupt the Service, its security, or its infrastructure;
- share account credentials beyond the users permitted by your plan; or
- upload content that is unlawful, infringing, or harmful.
5. Intellectual Property
The Service — including its software, content, curriculum, questions, characters, designs, logos, and trademarks — is owned by AceURMath or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, family, or authorized classroom use, in accordance with these Terms. All rights not expressly granted are reserved.
6. Your Content & Feedback
If you submit content to the Service (for example, a photo of a math problem using the Homework Scanner), you grant us a limited license to use, process, and store that content as needed to provide and improve the Service, consistent with our Privacy Policy. If you send us feedback or suggestions, you grant us the right to use them without obligation to you.
7. Educational & AI Disclaimer
AceURMath is a learning aid. Our AI Tutor and Homework Scanner provide explanations and step-by-step help, but they may occasionally be incomplete or inaccurate. They are not a substitute for a teacher, and we do not guarantee specific grades, test scores, or educational outcomes. Always review results and use your own judgment, especially for graded or high-stakes work.
8. Third-Party Services & App Stores
The Service relies on third parties, including the Apple App Store, Google Play, and payment processors. Your use of those services is also subject to their terms. We are not responsible for third-party services we do not control.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
10. Limitation of Liability
To the fullest extent permitted by law, AceURMath will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, or goodwill, arising out of your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the claim arose. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless AceURMath and its affiliates, officers, and employees from any claims, damages, or expenses arising out of your misuse of the Service or your violation of these Terms.
12. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Before filing a formal claim, you agree to first contact us at [email protected] so we can try to resolve the issue informally. Any disputes not resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in California.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
15. Apple App Store Additional Terms
If you download AceURMath from the Apple App Store, the following additional terms apply. In the event of a conflict between these terms and the rest of the Terms, these Apple-specific terms control for the Apple App Store version:
- Parties. These Terms are between you and AceURMath only, not with Apple. Apple is not responsible for the Service or its content.
- License scope. Your license to use the app is limited to a non-transferable license to use it on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
- Maintenance & support. AceURMath, not Apple, is solely responsible for providing any maintenance and support for the app.
- Warranty. AceURMath is solely responsible for any product warranties. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation.
- Claims. AceURMath, not Apple, is responsible for addressing any claims relating to the app, including product-liability, legal, regulatory, and consumer-protection claims, and any claim that the app infringes a third party's intellectual-property rights.
- Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
